A common question

What happens if TDS is not deducted or paid?

The business can be treated as in default: interest on the amount, late fees for statements, and in many cases the expense can be disallowed in the tax computation.

Most of this is avoidable with a monthly check: right section, right rate, deposited, statement filed.

The rules, in plain English

What the Law Says

Income-tax Act, 2025

In force from 1 April 2026

Income earned up to 31 March 2026 is still assessed under the Income-tax Act, 1961. From 1 April 2026 the 2025 Act applies, with a single 'tax year', renumbered sections and new form numbers under the Income-tax Rules, 2026.

Deduction and collection

Tax is deducted at source on salaries and many business payments, and collected at source on certain sales, at the rates and limits the law prescribes for each.

Consequences of default

Failing to deduct or deposit tax leads to interest and fees, and can make the related expense non-deductible.

Questions we get asked

TDS and TCS Questions, Answered

How often is TDS paid and filed?

Tax deducted is deposited monthly, and statements are filed every quarter. Certificates are then issued to the payees.

What are the new TDS certificate numbers?

Under the Income-tax Rules, 2026 the salary certificate formerly Form 16 is Form 130, and the non-salary certificate formerly Form 16A is Form 131. They apply from tax year 2026-27; certificates for earlier years keep the old numbers.

Can a TDS statement be corrected?

Yes. Correction statements can fix PAN errors, challan details and short deductions.

Is TDS needed on payments to foreign vendors?

Often yes, subject to the nature of the payment and any tax treaty. See our page on Forms 15CA and 15CB, now Forms 145 and 146.
